1. Agreement to Terms
By engaging TaxByAkram, operated by Shaik Akram Basha ("Service Provider," "we," "us," or "our"), for tax consulting services, you ("Client," "you," or "your") agree to be bound by these Terms of Service. These terms constitute a legally binding agreement governed by the Indian Contract Act, 1872, and other applicable laws of India.
2. Services Offered
TaxByAkram provides the following professional services:
- Income Tax Services: Tax planning, ITR filing (ITR-1, ITR-2, ITR-3, ITR-4), responding to notices, and tax advisory
- GST Services: GST registration, GSTR-1 and GSTR-3B filing, GST reconciliation, and compliance advisory
- Financial Services: Preparation of financial projections for business loans and investments
- Consultation: Remote and in-person tax consultation sessions
3. Client Responsibilities
As a client, you agree to:
- Provide accurate, complete, and truthful information required for tax filing
- Submit all necessary documents within the requested timeframe
- Inform us of any changes in your financial situation that may affect filings
- Review and approve all returns before filing
- Pay agreed fees within the specified payment terms
- Maintain confidentiality of any login credentials shared with you
You acknowledge that under Section 277 of the Income Tax Act, 1961, providing false information to tax authorities is a punishable offense. We rely on the information you provide and are not responsible for errors arising from incorrect or incomplete information furnished by you.
4. Service Provider Responsibilities
We commit to:
- Provide services with professional competence and due diligence
- Maintain confidentiality of all client information
- File returns before applicable due dates (subject to timely document submission)
- Keep you informed about the status of your filings
- Provide post-filing support for queries related to filed returns
- Stay updated with latest tax laws and regulations
5. Fees and Payment
5.1 Fee Structure
Service fees will be communicated before commencement of work. All fees are in Indian Rupees (INR) and are subject to GST at applicable rates (currently 18% for professional services).
5.2 Payment Terms
- Advance payment may be required for certain services
- Payment can be made via UPI, bank transfer, or other accepted methods
- Full payment is due before filing of returns unless otherwise agreed
- Late payments may attract interest at 1.5% per month
5.3 GST Compliance
As a registered GST provider, we will issue proper tax invoices for all services rendered. You may claim Input Tax Credit (ITC) on our services if you are a registered GST dealer.
6. Limitation of Liability
To the maximum extent permitted by law:
- Our liability shall be limited to the fees paid for the specific service in question
- We shall not be liable for penalties, interest, or additional tax arising from incorrect information provided by you
- We are not responsible for delays caused by government portals, technical issues, or circumstances beyond our control
- We do not guarantee specific tax savings or refund amounts as these depend on individual circumstances and tax laws
- Consequential, indirect, or special damages are expressly excluded
7. Intellectual Property
All content on our website, including text, graphics, logos, and educational materials, is the property of TaxByAkram and protected under the Copyright Act, 1957. You may not reproduce, distribute, or create derivative works without our written consent.
8. Confidentiality
We maintain strict confidentiality of all client information. We will not disclose your financial or personal information to any third party except: (a) as required by law or government authorities, (b) with your explicit written consent, or (c) to professional advisors under confidentiality obligations. This obligation survives termination of our engagement.
9. Termination
Either party may terminate the engagement:
- By mutual written agreement
- By the client, with payment of fees for work completed
- By us, if the client fails to provide required information or payment
- If the client requests us to engage in illegal or unethical practices
Upon termination, we will return all original documents provided by you. Work-in-progress files may be retained until all dues are cleared.
10. Dispute Resolution
In case of any disputes arising from these terms or our services:
- Parties shall first attempt to resolve the matter amicably through discussion
- If unresolved, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996
- The arbitration shall be conducted in Hyderabad, Telangana, India
- The language of arbitration shall be English
- The decision of the arbitrator shall be final and binding
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
12. Amendments
We reserve the right to modify these terms at any time. Changes will be effective upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified terms.
